A prenuptial agreement can dictate what will happen with assets and liabilities in the event of divorce or death, rather than leaving these issues open for a court to decide. A prenuptial agreement may address the issue of spousal support, i.e. maintenance, but may not dictate issues of child custody, parenting time and child support.
