NLRB Delays Posting Requirement

Yesterday, the National Labor Relations Board announced it is postponing the implementation date for its new notice-posting rule that requires employers to inform employees of their rights under the National Labor Relations Act. The new effective date of the rule is January 31, 2012, a delay in over two months from the original implementation date of November 14, 2011. The NLRB states the postponement allows for enhanced education and outreach to employers and was in response to questions regarding which businesses fall under the Board’s jurisdiction. The NLRB is currently awaiting a summary judgment decision on this issue in a lawsuit filed by the National Association of Manufactures in the U.S. District Court in D.C. Hearing on the summary judgment motions is set for December 19 with a decision to be rendered by the Court before January 31, 2012.
